TERMS OF SERVICE

By accessing or using BeamTracer ("beamtracer.com"), including the Audio Visualizers, OSC-1 Oscilloscope, and BT Laser Studio applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by BeamTracer LLC, a California limited liability company located in San Mateo County, California ("we," "us," or "our").

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Certain features require a registered account. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately via our contact form if you suspect unauthorized access.

BeamTracer offers Free, Pro ($12/mo), Bundle ($24/mo), and Studio ($39/mo) subscription tiers. Annual billing is available at a discounted rate. All prices are in USD.

• Subscriptions are billed in advance on a monthly or annual basis via Stripe.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' advance notice to existing subscribers.

Every BeamTracer account includes free trial credits that let you use premium features — AI tools, ILDA and 4K export, laser DAC output, and more — before subscribing, so you can evaluate paid functionality at no cost. Because of this, paid plans are non-refundable, except where a refund is required by applicable law. You may cancel at any time; your access continues through the end of the current billing period and you will not be charged again. We do not issue refunds for partial billing periods. At our sole discretion we may refund duplicate or accidental charges, or genuine technical faults that prevented use of the Service. Purchased AI credits and consumed usage are non-refundable. Subscriptions purchased through the Apple App Store or Google Play are governed by the refund policies of those app stores.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Circumvent subscription tier restrictions or rate limits.
• Use automated scripts, bots, or scrapers to access the Service.
• Upload malicious content, malware, or content that infringes third-party rights.
• Resell, sublicense, or redistribute the Service or its output without authorization.

The Service, including all software, design, documentation, and branding, is proprietary to BeamTracer LLC. All rights reserved.

Your Content: You retain ownership of content you create using the Service (visualizer recordings, ILDA files, exported media). We claim no rights to your output.

Commercial Use: Commercial use of exported content (live shows, YouTube, client work) requires a Pro, Bundle, or Studio subscription. Free-tier output is for personal, non-commercial use only.

We respect intellectual property rights. If you believe content on the Service infringes your copyright, submit a DMCA notice to:

Include: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, (5) a statement of accuracy under penalty of perjury, and (6) your physical or electronic signature.

If your material was removed because of a copyright notice and you believe the removal resulted from mistake or misidentification, you may send a counter-notice through the same contact form. We will provide the required details when we notify you of a removal. In appropriate circumstances, we terminate accounts of repeat infringers.

The Service integrates with third-party services including Google (OAuth authentication), Stripe (payment processing), Supabase (cloud storage), Google Gemini (AI features), and Cloudflare (CDN/assets). Your use of these services is subject to their respective terms and privacy policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAMTRACER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless BeamTracer LLC, its officers, and agents from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) your use of laser equipment in connection with the Service.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in San Mateo County, California. You waive any objection to jurisdiction or venue in these courts.

For claims under $10,000, you agree to attempt resolution through good-faith negotiation before initiating legal proceedings.

We may update these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before taking effect. Continued use after changes constitutes acceptance of the revised Terms.

We may suspend or terminate your account for violation of these Terms, at our sole discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 7-14 survive termination.
